Executive Session
SAO Chief of Civil Frank stated that an Executive Session was not needed for today's
meeting. He explained that the State's Attorney's Office (SAO) has a request for case
settlement to allow for the full claim to be paid. As it stands now, the payment will be
received over the next 60 days with two separate installments. Frank stated that he is
seeking approval to accept this settlement and it's terms.
Frank addressed the Committee's consensus to give the SAO authority up to $10K to
settle litigations. He sees the mentioned settlement to fall within that authority, only
difference is the time value of less than $10K. He explained that if the Committee
agrees, it would be set under the purview of the SAO to accept settlement amounts
$10K or below. The Committee provided a consensus.
ASA Weldon stated the mentioned court case is 2024LA000613: Kane County versus
OM Huntly Realty, LLC. This case is related to the County's ordinance regarding the
impact fee for businesses. This case was filed because an impact fee was accessed,
but has not been collected. The SAO filed the case with the Circuit Court requesting
$66,667.47. The settlement would cover the entire amount. Weldon mentioned that
under the County's ordinance there is no fees, interest, or penalties listed for the
County to collect. The settlement amount that was requested is the same impact fee
that was accessed and is the maximum amount that the County can collect on this
matter. Weldon and Frank addressed questions and comments from the Committee.
Discussion ensued.
