REPEALING SECTION 14-2 OF THE KANE COUNTY CODE (LICENSES FOR RAFFLES) AND REPLACING IT WITH A NEW SECTION 14-2: LICENSES FOR RAFFLES AND POKER RUNS.

WHEREAS, the Illinois Raffles and Poker Runs Act, at 230 ILCS 15/ et seq., authorizes the governing body of a county to establish systems for the licensing of organizations to operate raffles; which the Kane County board has done; and
WHEREAS, Public Act 102-689 made substantive changes to the Illinois Raffles and Poker Runs Act, expanding definitions of organizations authorized to apply for a raffle license, namely fire protection agencies; and
WHEREAS, the County of Kane seeks to amend its ordinances consistent with the changes implemented by Public Act 102-689;
NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that the current Section 14-2 of the Kane County Code be repealed and replaced by the new Section 14-2, entitled Licenses for Raffles and Poker Runs, as provided below:
ARTICLE 14-2: LICENSES FOR RAFFLES AND POKER RUNS:
Section A. Governing Law
Whenever reference is made in this Ordinance to "state law" it shall mean and refer to any act of the General Assembly regulating certain games of chance, including but not limited to the Raffles and Poker Runs Act, all as amended from time to time. Raffles and poker runs are licensed by the governing body with jurisdiction over the Key Location. A license shall authorize the holder of such license to sell raffle chances throughout the State, including beyond the borders of Kane County.
Section B. Licensing Agent
As used in this Ordinance the terms "raffle licensing agent", "poker run licensing agent" or "licensing agent", means the Kane County Clerk.
