WHEREAS, Court Services is mandated by 730 ILCS 110, the Probation and Probation Officers Act, to take charge of and watch over all persons placed on probation, preserving complete and accurate records of the person's term of probation including case notes, investigations, court records, assessments, and other personal and confidential information required by the Administrative Office of Illinois Courts (AOIC); and

WHEREAS, the 16th Judicial Circuit has an existing contract with Tyler Technologies Inc. for a case management system for the court's records that is utilized by the Judicial Partners including the Circuit Clerk, Judiciary, State's Attorney, and Public Defender; and

WHEREAS, 730 ILCS 110/15.1 (f) allows for Court Services to use monies from the probation fees fund, upon the direction of the Chief Judge, to support the standards required by the AOIC and facilitate services to the probationers placed under our charge; and

WHEREAS, section 2-216(E) of the Kane County Code, Procedures for Purchase of Items Not Suitable for Competitive Bid, 50 ILCS 5/5- 1022 (c), allows for the purchase of additional proprietary licensing for computer software and databases that have previously been competitively procured without requiring an additional competitive bid for the additional services; and

WHEREAS, Court Services' staff efficiency and productivity will benefit from an integration with the 16th Judicial Circuit's current CMS provider, Tyler Technologies Inc.; and

WHEREAS, Court Services has evaluated the Tyler Technology Inc. software for its applicable use, it meets the standards set forth by the AOIC, and the process of modification and implementation have been negotiated satisfactorily; and
