Adopting a Review and Approval Process for County Agreements

WHEREAS, the County Board must have the opportunity to review all agreements that require County Board approval so members are fully apprised of all the terms and conditions that are contained in such agreements; and
WHEREAS, establishing a process for the approval of such agreements will help ensure that the agreements contain terms and conditions that are acceptable to the County of Kane and its residents.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, when an agreement requires County Board approval, the appropriate County department shall provide the agreement and the proposed resolution to the State's Attorney's Office for review, subject to the State's Attorney's Office's policies and procedures.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Kane County Board, after any necessary review, the appropriate County department must include such agreement with the proposed resolution that is presented to the proper standing committee to proceed in the committee process for County Board consideration and approval, and the resolution must contain language that expressly approves of the agreement.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Kane County Board, resolutions that relate to a solicitation made in accordance with the Kane County Purchasing Ordinance (Chapter 2, Article VI, of the Kane County Code), for which the terms and conditions remain unaffected by a proposal, will be deemed in compliance with the requirements of this resolution if authorized by the Purchasing Department and the appropriate County department, and if a copy of the solicitation and the proposal are included with the resolution.
