AUTHORIZING AGREEMENT WITH THE BATTERY NETWORK, INC. FOR REIMBURSEMENT OF COLLECTION COSTS FOR BATTERIES COLLECTED BY KANE COUNTY FOR RECYCLING

WHEREAS, the Portable and Medium-Format Battery Stewardship Act (P.A. 103-1033) became Illinois law in 2024 (415 ILCS 205); and
WHEREAS, in October of 2025, the Illinois EPA approved a battery stewardship program plan submitted by the non-profit The Battery Network, Inc. (formerly Call2Recycle) to administer a battery stewardship program under the framework of the Act; and
WHEREAS, the Act requires The Battery Network to work with units of local government to establish collection sites at local government facilities and to reimburse local governments for demonstratable costs related to collection of batteries (415 ILCS 205/35); and
WHEREAS, Kane County's Recycling Program has established a public collection site through the program at its Fabyan Parkway Recycling Center whereby The Battery Network provides the County with battery collection containers and shipping at no direct cost to the County; and
WHEREAS, The Battery Network has provided Kane County with a standardized weight-based reimbursement agreement of $0.20 (Twenty Cents) per pound of batteries collected and sent for recycling; and
WHEREAS, in order to enter into the reimbursement agreement, the County Board must authorize contract language which limits liability and provides indemnification to The Battery Network under certain conditions.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes its Chairman to enter into an agreement with The Battery Network, with agreement language attached hereto as Exhibit A, to recoup expenses related to the collection of batteries from the public for recycling.
