APPROVING AMENDMENT NO. 1 TO THE AGREEMENT WITH V3 COMPANIES, LTD. OF WOODRIDGE, ILLINOIS FOR PHASE III CONSTRUCTION ENGINEERING SERVICES FOR THE BLISS ROAD, MAIN STREET ROAD, FABYAN PARKWAY INTERSECTION IMPROVEMENT, KANE COUNTY SECTION NO. 14-00288-01-PV

WHEREAS, pursuant to Resolution No. 22-151, the County of Kane (hereinafter the "County") approved a Phase III Construction Engineering Services Agreement (hereinafter the "Agreement") with V3 Companies, Ltd of Woodridge, Illinois which appropriated One Million Two Hundred Ninety Eight Thousand One Hundred Seventy Six and 88/100 Dollars ($1,298,176.88), (hereinafter the "Appropriation") required for the Bliss Road, Main Street Road, Fabyan Parkway Intersection Improvement (hereinafter the "Improvement"); and
WHEREAS, the original term of the Agreement expired on December 31, 2023 before the completion of the previously approved Improvement; and
WHEREAS, it is in the County's best interest to enter into an Amendment No. 1 to extend the date of the Agreement to November 30, 2025, to allow for the completion of the work intended as part of the Improvement; and
WHEREAS, the extension of the Agreement between the parties through the proposed amendment will not require any additional appropriation from the County to complete the Improvement.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Amendment No. 1 to the Agreement with V3 Companies, Ltd. is hereby approved and the Chairman of the Kane County Board is hereby authorized and directed to execute the proposed Amendment No. 1.
