ADOPTION OF A REVISED SCHEDULE OF FEES FOR STORMWATER PERMITS IN UNINCORPORATED KANE COUNTY AND NON-CERTIFIED COMMUNITIES

WHEREAS, Kane County Environmental and Water Resources serves as the Administrator of Unincorporated Kane County and Non-Certified Communities under the Kane County Stormwater Ordinance; and
WHEREAS, the Stormwater Ordinance requires that fees be set by separate Ordinance by each Administrator; and
WHEREAS, the Kane County Board retained Fiscal Consulting, LLC in 2018 to develop the actual costs of Stormwater permit administration, reviews and inspections based on the hourly rate of permit reviewer staff including overhead and benefits; and
WHEREAS, since the adoption of the 2019 rate schedule, a salary survey was conducted as well as cost-of-living increases received and therefore the hourly rate that was previously established in 2019 should be adjusted accordingly as well as reflected in the fees; and
WHEREAS, the 2019 Kane County Stormwater Management Ordinance allows for a fee-in-lieu to be paid for Best Management Practices and as such, data was collected since the passage of the 2019 Ordinance to set a fee-in-lieu of BMP rate and is reflected in the revised fee schedule.
NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that the schedule of Stormwater Permit Fees as adopted in Ordinance 19-142 is repealed in its entirety and the following schedule of Stormwater Permit fees for Unincorporated Kane County and Non-Certified Communities is hereby adopted and said fee schedule shall be effective January 1, 2026.
