APPROVING AN AGREEMENT WITH COMMONWEALTH EDISON COMPANY FOR REIMBURSABLE UTILITY ADJUSTMENT FOR THE RANDALL ROAD AT HOPPS ROAD INTERSECTION IMPROVEMENT AND GRADE SEPARATION PROJECT, KANE COUNTY SECTION NO. 19-00511-00-CH

WHEREAS, Commonwealth Edison Company ("ComEd") has existing electric transmission facilities within and adjacent to the limits of the Randall Road at Hopps Road and over CC&P Railroad Project (hereinafter the "Project") that must be adjusted or relocated to accommodate the proposed construction; and
WHEREAS, pursuant to ComEd's tariff and applicable state regulations, the County of Kane is responsible for the costs associated with said utility adjustments; and
WHEREAS, the Project is anticipated to utilize federal funding administered through the Illinois Department of Transportation (IDOT) requiring compliance with applicable federal regulations, including Buy America requirements; and
WHEREAS, IDOT has required that ComEd comply with Buy America provisions when sourcing steel materials for the manufacture of new utility poles and associated facilities used in the relocation; and
WHEREAS, the County of Kane and ComEd have negotiated an Agreement for Reimbursable Utility Adjustment outlining the scope of work, reimbursement terms, federal compliance requirements, and responsibilities of each party for the relocation of ComEd facilities necessitated by the Project.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board hereby approves the Agreement for Reimbursable Utility Adjustment between the County of Kane and Commonwealth Edison Company for utility adjustments associated with the Randall Road at Hopps Road and over CC&P Railroad Project and the Kane County Board Chairman is hereby authorized to execute an agreement therefor.
