APPROVING AN AGREEMENT WITH ALDI, INC. FOR KIRK ROAD AT DOUGLAS ROAD INTERSECTION IMPROVEMENT, KANE COUNTY SECTION NO. 24-00377-01-CH

WHEREAS, the County of Kane ("County") and ALDI, Inc. ("ALDI") desire to enter into an agreement for road improvements to be made to Kane County Highway No. 77 ("Kirk Road") at Douglas Road in the City of Batavia, Illinois (hereinafter the "Project"); and
WHEREAS, ALDI has requested permanent full access to the east side of Kirk Road at Douglas Road, being the east leg of the intersection; and
WHEREAS, the State of Illinois awarded ALDI a grant of up to Two Million Dollars ($2,000,000.00) in Economic Development Program ("EDP") funds to assist in roadway improvements necessary to accommodate ALDI's corporate campus expansion; and
WHEREAS, the Project will include the widening of Kirk Road and the addition of turn lanes at the intersection of Kirk Road and Douglas Road, together with all other appurtenant work necessary to complete the Project in accordance with approved plans and specifications; and
WHEREAS, the EDP grant will provide up to a Two Million Dollar ($2,000,000.00) investment in the Project with a mandatory fifty percent (50%) local cost share, to be funded by ALDI; and
WHEREAS, the Agreement establishes the respective responsibilities of the parties for impact fees, engineering, utility relocation and protection, right-of-way acquisition, permitting, funding, construction, maintenance, insurance, and indemnification for the Project.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board hereby approves permitting said access for ALDI and an agreement between the County of Kane and the Aldi, Inc. for the Project and that the Kane County Board Chairman is hereby authorized and directed to execute an agreement therefor.
