WHEREAS, pursuant to Resolution 17-359, the Kane County Board previously approved the engagement of the law firm of Meyers & Flowers, LLP, to represent Kane County in litigation pursuing claims against certain opioid manufacturers and distributors in response to the nationwide opioid epidemic in order to recover the financial costs incurred by the County and other public agencies in response to that crisis; and

WHEREAS, Meyers & Flowers, LLP, has continued to represent Kane County in such matters to recover financial costs incurred by the County; and

WHEREAS, pursuant to Resolution 21-283, the Kane County Board authorized the Kane County State's Attorney to execute an Allocation Agreement with the Illinois Attorney General's Office to provide for the allocation of the distribution of proceeds from any settlements or judgments; and

WHEREAS, pursuant to Resolution 23-226, the Kane County Board authorized the Kane County State's Attorney to execute documentation required by the various aspects of the opioid litigation in order to effectuate and expedite receipt of any funds resulting from litigation and/or settlements of the opioid litigation; and

WHEREAS, the Kane County Board is aware of proposed settlements, specifically, a Direct Settlement with the Sackler Family and a bankruptcy estate plan and settlement with Purdue Pharma LP; and

WHEREAS, the Kane County Board desires for Kane County to participate in the Direct Settlement with the Sackler Family and the bankruptcy estate plan and settlement with Purdue Pharma LP and seeks to give the Kane County State's Attorney authority to take actions to effectuate such settlements.
