APPROVING AMENDMENT NO. 1 TO THE PHASE I ENGINEERING SERVICES AGREEMENT WITH BAXTER & WOODMAN, INC. OF CHICAGO, ILLINOIS FOR GALLIGAN ROAD FROM FREEMAN ROAD TO BINNIE ROAD, KANE COUNTY SECTION NO. 21-00532-00-CH

WHEREAS, pursuant to Resolution No. 21-477, the County of Kane approved a Phase I engineering services agreement (hereinafter the "Agreement") with Baxter & Woodman, Inc. and appropriated Six Hundred Eight Thousand Three Hundred Ninety-Nine Dollars ($608,399.00), (hereinafter the "appropriation") for the improvement of Galligan Road from Freeman Road to Binnie Road (hereinafter the "Improvement"; and
WHEREAS, additional engineering services identified within the scope of work set forth in the Agreement are necessary for the successful completion of the Improvement; and
WHEREAS, to address the need for additional engineering services, the County desires to amend the Agreement, (hereinafter the "Amendment"), (a copy of which Amendment is on file in the office the Kane County Clerk) by increasing the engineering services appropriation by an additional $90,901.00; and
WHEREAS, it is in the County's best interest to extend the upper limit of the appropriation as set forth in the Agreement and the Amendment by an additional Ninety Thousand Nine Hundred One Dollars ($90,901.00) from $608,399.00 to $699,300.00.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Amendment to the Agreement is hereby approved and that the Chairman thereof is hereby authorized and directed to execute the Amendment.
BE IT FURTHER RESOLVED that there is hereby appropriated the sum of Ninety Thousand Nine Hundred One Dollars ($90,901.00) from Transportation Sales Tax Fund #305, Line Item #50140 (Engineering Services) for a total appropriation for the Agreement and its Amendment not to exceed Six Hundred Ninety-Nine Thousand Three Hundred Dollars ($699,300.00).
