WHEREAS, Kane County Board Resolution No. 97-344 established the Kane County Community Development Block Grant (CDBG) Program, and Resolution No. 04-06 established the Kane-Elgin HOME Consortium; and

WHEREAS, said programs are funded by the U.S. Department of Housing and Urban Development (HUD); and

WHEREAS, the Fox Valley Park District intends to implement a project with federal financial assistance under Section 9 of the United States Housing Act of 1937, subject to completion of an environmental review pursuant to the National Environmental Policy Act of 1969 (NEPA) and implementing regulations of the U.S. Department of Housing and Urban Development (HUD), including but not limited to HUD's regulations at 24 CFR Part 58; and

WHEREAS, the Park District is the recipient of $2.8 Million in federal financial assistance from HUD; and

WHEREAS, the Park District must secure assistance for completing an environmental review from a unit of general local government where the project is located, and such local government must agree to act as the Responsible Entity ("RE"), as defined under HUD regulations; and

WHEREAS, Kane County is an eligible RE under HUD's Environmental Review implementing regulations at 24 CFR Part 58, and both HUD and the Park District have requested the County's assistance in completing the required Environmental Review for said project (defined as the "Lippold Park Bicycle and Pedestrian Bridge Project"); and
