AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH MCHENRY COUNTY FOR JUVENILE DETENTION SERVICES

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of local government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function in any matter not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay costs related to intergovernmental activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service involved provided that the unit of local government contracting with the county has authority to perform the service; and
WHEREAS, McHenry County's current intergovernmental agreement for juvenile detention services with Kane County charges a per diem of $175 (one hundred and seventy-five dollars) and does not expire until December 1, 2026. That agreement states that it may be amended with written consent of all parties. McHenry County was informed that it is no longer equitable for Kane County to charge a per diem rate of $175.00 (one hundred and seventy-five dollars) and that it would be necessary to amend the agreement. McHenry County has agreed to enter into a new agreement wherein Kane County will house McHenry County minors at its Juvenile Justice Center with a per diem of $225.00 (two hundred and twenty-five dollars) per day per minor; and
WHEREAS, the new intergovernmental agreement with McHenry County commences on July 1, 2026, and runs through December 1, 2029. This agreement may be amended with the written consent of all parties hereto and, provided a need continues to exist and may be renewed thirty (30) days prior to the e...
