Approving an Amendment to the Agreement with Peralte-Clark, LLC of Arlington Heights, Illinois for Fabyan Parkway Intersection Improvements at Settlers Hill and Kingsland Drive, Kane County Section No. 21-00373-01-CH

WHEREAS, pursuant to Resolution No. 23-72, the County of Kane approved a Phase I/II engineering services Agreement (hereinafter the “Agreement”) with Peralte-Clarke, LLC (“Consultant”) and appropriated Seven Hundred Eighty-Eight Thousand Two Hundred Thirty-Six Dollars ($788,236.00), (hereinafter the “appropriation”); and
WHEREAS, the terms of the Agreement between the County and Consultant will expire on August 8, 2026; and
WHEREAS, unobligated funds are still available under the original Agreement and Consultant is actively working towards completion of various tasks contemplated within the Agreement; and
WHEREAS, it is in the County’s best interest to extend the end date of the Agreement from August 8, 2026 to August 8, 2029 to expend the allowable funds and provide sufficient time for Consultant to complete all the approved tasks within the Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Amendment to the Agreement with Peralte-Clarke Group, LLC is hereby approved and that the Chairman thereof is hereby authorized to execute the Amendment along with any other contemplated by the Agreement and this amendment thereto.
