AUTHORIZING AN ADDENDUM TO THE INTERGOVERNMENTAL AGREEMENT WITH ROCK ISLAND COUNTY FOR JUVENILE DETENTION SERVICES

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of local government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function in any matter not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay costs related to intergovernmental activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service involved provided that the unit of local government contracting with the county has authority to perform the service; and
WHEREAS, on December 1, 2025, Rock Island County entered into an intergovernmental agreement with Kane County wherein Kane County houses Rock Island County minors at its Juvenile Justice Center with a per diem charge of $225.00 (two hundred and twenty-five dollars) per day per minor. That agreement states that the JJC will only transport Rock Island County minors to non-scheduled, off-site medical care services, such as, emergency hospital care. For those transports, Rock Island County will compensate Kane County for mileage, any other transportation expenses incurred and staffing coverage at an hourly rate of $100; if the transport occurs on a holiday, the rate will be $150 per hour; and
WHEREAS, Rock Island County has requested to amend our intergovernmental agreement to reflect that the JJC will also provide transportation for Rock Island County youth for scheduled off-site medical care, such as routine medical and dental examinations.
