APPROVING THE ACQUISITION OF REAL PROPERTY FOR THE RANDALL ROAD AT HOPPS ROAD INTERSECTION AND CANADIAN NATIONAL RAILROAD GRADE SEPARATION IMPROVEMENT, KANE COUNTY SECTION NO. 19-00511-00-CH, PARCEL NO. 0001

WHEREAS, the County of Kane (County) is authorized pursuant to the Illinois Compiled Statutes, 605 ILCS 5/5-801 (2020), to acquire real property by negotiated purchase with real property owners for highway purposes; and
WHEREAS, the County has developed right-of-way plans for the proposed improvement of Kane County Highway No. 34 ("Randall Road") at Hopps Road for a proposed improvement, more particularly described as Kane County Sec. No. 19-00511-00-CH (hereinafter the "Project"); and
WHEREAS, the Project right-of-way plans require the acquisition of Parcel No. 0001; and
WHEREAS, Stony Creek Shopping Center LLC, the property owner of Parcel No. 0001 which is legally described in the Acquisition Agreement attached hereto and designated as Exhibit "A" (a copy of which is on file in the office of the Kane County Clerk), has agreed to sell its interest in the parcel identified above for the sum of Seventy Thousand Dollars ($70,000.00). Stony Creek Shopping Center LLC, and the County have mutually agreed thereto pursuant to the terms set forth in the Acquisition Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane accept the offer of Stony Creek Shopping Center LLC, the property owner of Parcel No. 0001, in the amount of Seventy Thousand Dollars ($70,000.00) to be paid from the Motor Fuel Tax Fund #302, Line Item #74010 (Highway Right of Way) and the Chairman of the Kane County Board is hereby authorized and directed to execute the Acquisition Agreement and any associated documents consistent with the aforementioned acquisition.
