AUTHORIZING A LICENSE AGREEMENT FOR DARK FIBER WITH ISI COMMUNICATIONS, INC.

WHEREAS, the Kane County Information Technologies Department is responsible for fiber infrastructure within Kane County and, as such, provides connectivity to several government offices; and
WHEREAS, section 5-1190 of the Counties Code (55 ILCS 5/5-1190) authorizes counties to lease, license, or otherwise grant access to, and use of infrastructure, including fiber optic cables, that a county owns or controls to public or private entities to facilitate the delivery of broadband services; and
WHEREAS, the Information Technologies Department considers it in the best interest of the County to enter into a license agreement for four (4) dark fibers for a four (4)-year term with the option of four (4) renewals of four (4) years each; and
WHEREAS, the Information Technologies Department has determined that it is in the best interest of the County to license fiber to ISI Communications Inc
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is hereby to enter into a license agreement with ISI Communications Inc, for the license of four (4) dark fibers for a four (4)-year term with the option of four (4) renewals of four (4) years each, at a cost not to exceed Forty-Four Thousand Six Hundred Forty-Eight Dollars and Ninety-Five Cents ($44,648.95) over four (4) years.
