AUTHORIZING EXTENSION OF AND SECOND AMENDMENT TO THE PROGRAM DEVELOPMENT AND ADMINISTRATIVE SERVICES AGREEMENT BETWEEN THE COUNTY OF KANE AND THE ILLINOIS ENERGY CONSERVATION AUTHORITY NFP (IECA) FOR THE KANE ENERGY EFFICIENCY PROGRAM (KEEP) AS A PROPERTY ASSESSED CLEAN ENERGY PROGRAM (PACE)

WHEREAS, "Property Assessed Clean Energy" is a financing tool that helps accelerate private investments in commercial properties, and locally adopted programs have already brought billions of private investment dollars to communities across the U.S. since the first "Property Assessed Clean Energy" program launched in 2008; and
WHEREAS, pursuant to the Illinois Property Assessed Clean Energy Act at 50 ILCS 50/1, et seq., the County may create, adopt, and administer a property assessed clean energy program; and
WHEREAS, on December 11, 2018, the County Board passed Ordinance 18-459, establishing such a program; and
WHEREAS, the "Property Assessed Clean Energy Act" states that a program may be administered by a program administrator or the local unit of government with associated fees making the program with no cost of the County or general public; and
WHEREAS, on August 14, 2018, the County Board Approved Resolution 18-283 Authorizing an Agreement between the County of Kane and the Illinois Energy Conservation Authority NFP (IECA) to provide Program Administration Services for the Kane Energy Efficiency Program (KEEP) as a "Property Assessed Clean Energy" program for Kane County, which agreement provided for an initial three-year term and two subsequent optional three-year renewal terms; and
WHEREAS, the Count Board desires to exercise the second and final three year renewal term; and
WHEREAS, the County Board desires to extend and amend the original service agreement and continue the Kane Energy Efficiency Program (KEEP) as a Property Assessed Cleaner Energy Program (PACE).
