APPROVING AN AGREEMENT WITH CHICAGO, CENTRAL AND PACIFIC RAILROAD AND ACQUISITION OF REAL PROPERTY FOR THE RANDALL ROAD AT HOPPS ROAD INTERSECTION AND CNRR GRADE SEPARATION IMPROVEMENT, KANE COUNTY SECTION NO. 19-00511-00-CH, PARCEL NO. 0004PE-A&B

WHEREAS, the County of Kane (County) is authorized pursuant to the Illinois Compiled Statutes, 605 ILCS 5/5-801 (2020), to acquire real property for highway purposes by negotiated purchase; and
WHEREAS, the County has developed right-of-way plans for Kane County Highway No. 34 ("Randall Road") at Hopps Road for a proposed improvement, more particularly described as Kane County Sec. No. 19-00511-00-CH (hereinafter the "Project"); and
WHEREAS, the Project right-of-way plans require the acquisition of Project Parcel No. 0004PE-A&B from the Chicago, Central and Pacific Railroad Company (the "Railroad"); and
WHEREAS, the County filed a petition with the Illinois Commerce Commission ("ICC") for the purposes of obtaining approval to construct the necessary improvements relative to the Project that required access to property owned by the Railroad"); and
WHEREAS, the County and the Railroad have negotiated an Agreement For Local Agency Highway-Railway Grade Separation Improvements ("Agreement") attached hereto and designated as Exhibit "A" (a copy of which is on file in the office of the Kane County Clerk) whereby the County will be able to access the acquired project parcel No. 0004PE- A&B as part of the construction of the proposed improvements relative to the Project; and
WHEREAS, the County and the Railroad are parties to an Order entered by the ICC which grants the County access to the Project parcels, and sets an agreed upon compensation amount for project parcel No. 0004PE- A&B; and
