Location: 49W105 Ellithorpe Road (04-29-200-002), Burlington Township.

Proposed: Rezoning from F-District Farming to F-1 District Rural Residential to allow the creation of two new residential parcels. As part of the petition the owners are also requesting a building size variance to bring the existing accessory buildings into conformance with the Zoning Ordinance.

Zoning Board: Approval with the following stipulations:
1.
                     For any Development in the future as defined by the Kane County Stormwater Management Ordinance on the resulting F-1’s and F parcels that singularly results in greater than 5,000 sq ft of new impervious area, or cumulatively (as of Jan 1, 2002) results in greater than 25,000 sq ft of new impervious area or 3 acres of disturbance, Stormwater Management Measures, as required by the Kane County Stormwater Ordinance, shall be provided.
2.         The ultimate half south right of way from the centerline of Ellithorpe Road is 60 feet. Therefore, any new structures are to be placed outside of a 35 foot building setback measured from the ultimate right of way line.
