APPROVING THE ACQUISITION OF REAL PROPERTY FOR KIRK ROAD OVER UNION PACIFIC RAILROAD COMPANY BRIDGE RECONSTRUCTION PROJECT IN GENEVA, ILLINOIS, KANE COUNTY SECTION NO. 12-00192-04-BR, PARCEL NO. 0001, PARCEL NO. 0001TE-1 & PARCEL NO. 0001TE-2

WHEREAS, the County of Kane ("County") is authorized pursuant to the Illinois Compiled Statutes, 605 ILCS 5/5-801 (2020), to acquire real property by negotiated purchase with real property owners for highway purposes; and
WHEREAS, the County has developed right-of-way plans for the proposed improvement of Kane County Highway No. 77 (Kirk Road) over the Union Pacific Railroad tracks located in Geneva, Illinois, identified as Kane County Sec. No. 12-00192-04-BR (hereinafter the "Project"); and
WHEREAS, the Project right-of-way plans require the acquisition of Parcel No. 0001, Parcel No. 0001TE-1 and Parcel No. 0001TE-2; and
WHEREAS, RSGSF LLC, the property owner of Parcel No. 0001, Parcel No. 0001TE-1 and Parcel No 0001TE-2, which are legally described in the Acquisition Agreement attached hereto and designated Exhibit "A" (a copy of which is on file in the office of the Kane County Clerk), has agreed to sell its interest in the parcels identified above for the sum of Three Hundred Thousand Dollars ($300,000.00). The property owner and the County have mutually agreed thereto pursuant to the terms set forth in the Acquisition Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane accept the offer of RSGSF LLC, the property owner of Parcel No. 0001, Parcel No. 0001TE-1 and Parcel No. 0001TE-2, in the amount of Three Hundred Thousand Dollars ($300,000.00) to be paid from the Motor Fuel Tax Fund #302, Line Item #74010 (Highway Right of Way) and the Chairman of the Kane County Board is hereby authorized and directed to execute the Acquisition Agreement and any associated documents therefor.
