MODIFYING SECTION 2-7-1 OF THE KANE COUNTY CODE (YOUTH HOME BOARDING RATE)

WHEREAS, Chapter 2 (Administration), Article I (In General), Section 2-7-1 (Youth Home Boarding Rate) of the Kane County Code sets out a charge rate for detention at $105 per day for in circuit youth or $150 per day for out of circuit youth unless there is an intergovernmental agreement in place requiring otherwise; and
WHEREAS, the Kane County Board last updated the Code's rate in 1996 but has approved several iterations of intergovernmental agreements with other counties using detention services at the Kane County Juvenile Justice Center since that time; and
WHEREAS, the rate of economic inflation is variable and better handled with intergovernmental agreements allowing a more timely response to budgetary needs rather than through a static county code.
NOW, THEREFORE, BE IT ORDAINED that the Kane County Board that Section 2-7-1 (Youth Home Boarding Rate) of the Kane County Code is hereby modified as follows:
2-7-1: YOUTH HOME BOARDING RATE:
Unless otherwise provided The charge made to counties for use of the Kane County Juvenile Justice Center to house juveniles arrested on serious criminal offenses shall be reflective of the cost per day per bed in a separate intergovernmental agreements that are approved by the County Board. The Juvenile Justice Center is authorized to charge the prevailing current rate in exigent circumstance or for other limited reasons that are not covered by an intergovernmental agreement. the charge made to counties located within the sixteenth judicial circuit for boarding youths at the Kane County youth home is one hundred five dollars ($105.00) per day. The charge made to counties located outside the sixteenth judicial circuit for boarding youths at the Kane County youth home is one hundred fifty dollars ($150.00) per day.
