AUTHORIZING A LICENSE AGREEMENT WITH ZAYO GROUP, LLC FOR THE LICENSE OF DARK FIBER

WHEREAS, under section 5-1189 of the Counties Code, the lease, license, or use of infrastructure must (1) be granted on a nondiscriminatory, nonexclusive, and competitively neutral basis and (2) comply with all other State and Federal laws, rules, and regulations, including, but not limited to, all applicable safety codes and requirements; and

WHEREAS, Kane County owns and operates a Fiber Infrastructure for its telecommunications needs and has the authority and ability to provide fiber connectivity to various institutes and residents located within Kane County; and

WHEREAS, because it is cost efficient for Kane County to install the maximum feasible amount of fiber optic cable in its Fiber Infrastructure it possesses Surplus Dark Fiber; and

WHEREAS, the State of Illinois has recognized that it is a goal to make available to all citizens affordable, reliable, and state of the art internet communications through the expansion, extension, and general availability of broadband services and technology, and to encourage the adoption of broadband to all citizens (220 ILCS 80/5); and

WHEREAS, it is in the best interest of Kane County and its citizens for there to be access to high-speed fiber-based internet service throughout the County; and

WHEREAS, it is in the best interest of Kane County to facilitate the delivery of broadband services by licensing its Surplus Dark Fibers to third parties, including public and private entities, on a nondiscriminatory, nonexclusive, and competitively neutral basis for the purpose of using those Surplus Dark Fibers to provide high speed fiber-based internet services to businesses and residents of Kane County; and
