AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF KANE, THE KANE COUNTY SHERIFF'S OFFICE, AND THE OSWEGO POLICE DEPARTMENT

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine or transfer any power of function in any manor nor prohibited by law or by ordinance and may use their credit, revenues and other resources to pay cost related to intergovernmental activities; and
WHEREAS, pursuant to 725 ILCS 5/107-4, this Agreement recognizes that a peace officer has authority in jurisdictions other than its own in certain circumstances; and
WHEREAS, the Kane County Sheriff's Office maintains a certified Bomb Squad trained and equipped to respond to incidents involving explosives, hazardous ordnance, improvised explosive devices (IEDs), and post-blast investigations; and
WHEREAS, the Oswego Police Department recognizes the importance of having timely access to specialized bomb disposal services to protect its community and first responders; and
WHEREAS, the Kane County Sheriff's Office agrees to provide such services to the Village of Oswego on an as-needed basis; and
WHEREAS, the Oswego Police Department agrees to support the mission of the KCSO Bomb Squad by assigning sworn officers to serve in part-time support roles within the unit and will provide their assigned officers with any and all equipment necessary for this activity; and
WHEREAS, both agencies acknowledge that collaborative sharing of personnel and resources enhances regional public safety and strengthens operational readiness; and
WHEREAS, the Kane County Sheriff's Office will not incur any additional expenses due to this arrangement; and
