APPROVING ACQUISITION OF REAL PROPERTY FOR DAUBERMAN ROAD EXTENSION, PARCEL NO. 1N20009, KANE COUNTY SECTION NO. 15-00277-01-BR

WHEREAS, the County of Kane (County) is authorized pursuant to the Illinois Compiled Statutes, 605 ILCS 5/5-801 (2020), to acquire real property for highway purposes by negotiated purchase; and
WHEREAS, the County has developed right-of-way plans for the Kane County Highway No. 62 (Dauberman Road) proposed improvement, Illinois, Kane County Sec. No. 15-00277-01-BR (hereinafter the "Project"); and
WHEREAS, the Project right-of-way plans require the acquisition of Project Parcel No. 1N20009 which are legally described in the Acquisition Agreement attached hereto and designated Exhibit "A" (a copy of which is on file in the office of the Kane County Clerk); and
WHEREAS, the State of Illinois has agreed to and is cooperating with the County, at the County's expense, assisting in the acquisition of highway right of way necessary for the Dauberman Road Extension at those locations where said Project intersects with the State Route (US 30) which will require improvement as a result of the construction of the Project; and
WHEREAS, the State has filed an eminent domain petition (Sixteenth Judicial Circuit Court Case No. 21ED006) and a motion for quick take to set preliminary just compensation for and acquire title to Parcel No. 1N009 from Executive Office Holdings, LLC, the record title holder thereof (hereinafter sometimes the "Owner"); and
WHEREAS, pursuant to Kane County Resolution No. 21-448, the County approved an appropriation in the amount of $138,000.00 in order to pay the Court's Preliminary Just Compensation Order to the Owner of Parcel No. 1N0009; and
WHEREAS, pursuant to the Court's Final Judgement Order, the Court determined the Owner is entitled to receive an additional sum of One Hundred Twenty-Six Thousand Dollars ($126,000.00) for dam...
