Resolution Authorizing the Agreed Upon 5-Year Renewal Extension with the Elgin R.C. Flyers Club at Freeman Kame Forest Preserve

WHEREAS, it is deemed necessary and desirable to approve the 5-year extension to the Use and License Agreement between the Forest Preserve District of Kane County, Kane County, IL, and the Elgin R. C. Flyers Club, for the use of a small area of the Freeman Kame Forest Preserve; and
WHEREAS, the Elgin R.C. Flyers Club have used and maintained a small area of land within the Freeman Kame Forest Preserve, south of Tower Hill Road for a radio-controlled airplane flying field for years and beginning prior to the District acquiring the land and have expressed the desire to exercise the mutually agreeable five (5) year extension option (one-time for a total of 10 years); and
WHEREAS, all other terms and conditions remain from the original Use and License Agreement with the expiration date of October 2031; and
WHEREAS, the Agreement, attached as Exhibit A, provides the continued set terms of each of the parties.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois, that the agreed upon 5-Year Extension to the Use and License Agreement attached hereto and made a part hereof as Exhibit A be, and hereby is approved. The President and Secretary of the Forest Preserve District of Kane County are hereby authorized and directed to execute said Use and License Agreement on behalf of said District in accordance with its terms.
