WHEREAS, pursuant to 55 ILCS 5/3-9006, the Kane County State's Attorney is required to procure the necessary services to perform the duties of the office; and

WHEREAS, the County of Kane and the Kane County State's Attorney's Office ("SAO") issued RFP No. 22-0050 on August 29, 2022, for electronic discovery software and support programs that streamline the process in which the SAO tenders discovery to the Public Defender's Office and other defense attorneys as part of its prosecutorial duties and functions; and

WHEREAS, a total of eleven proposals were received and evaluated per the evaluation criteria in the proposal document; and

WHEREAS, the vendor selected, Axon Enterprise, Inc., 17800 North 85th Street, Scottsdale, Arizona 85255 ("Axon"), received the highest evaluation score by the evaluation team; and

WHEREAS, Axon proposed the use of Justice Premiere, an umbrella package of products and services, and also agreed to expand its proposal to include the Public Defender's Office; and

WHEREAS, by Resolution No. 22-480, the Kane County Board authorized the execution of a contract with Axon in the amount of $2,665,521 (Two Million Six Hundred Sixty-Five Thousand Five Hundred Twenty-One Dollars) to provide Justice Premiere to the SAO and the Public Defender's Office for a ten (10) year term; and

WHEREAS, through a contract amendment to provide the use of Justice Plus, the SAO will continue to receive electronic discovery services from Axon Enterprise, LLC., and the SAO will receive additional licenses for use, and there will be additional software integrations, which are not suitable for competitive procurement, with programs that the SAO uses to perform the duties of the office; and
