AUTHORIZING THE EXPENDITURE OF FUNDS AND EXECUTION OF DEED OF AGRICULTURAL CONSERVATION EASEMENT FOR PROPERTY LOCATED ON LASHER ROAD, KANEVILLE TOWNSHIP (PROPERTY IDENTIFICATION NUMBERS: 10-34-300-008 AND 10-34-400-001) AND ALL RELATED DOCUMENTS FOR CLOSING AS PART OF THE KANE COUNTY AGRICULTURAL CONSERVATION EASEMENT AND FARMLAND PROTECTION PROGRAM

WHEREAS, Article V of Chapter 11 of the Kane County Code governs the Kane County Agricultural Conservation Easement and Farmland Protection Program, which was originally adopted by Ordinance No. 01-67; and

WHEREAS, section 11-134 of the Kane County Code authorizes the Kane County Board to acquire conservation interests in real property for the purpose of farmland protection; and

WHEREAS, the Kane County Development and Community Services Department recommends that the Kane County Board authorizes the acquisition of a conservation interest for property located on Lasher Road, Kaneville Township (Property Identification Numbers: 10-34-300-008 and 10-34-400-001) as part of the Kane County Agricultural Conservation Easement and Farmland Protection Program; and

WHEREAS, it is necessary for the Kane County Board to authorize the County Board Chairman and certain staff from the Kane County Development and Community Services Department to execute necessary documents for closing purposes.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes the following individuals to execute a deed of agricultural easement with RUSSELL S. RUH, Successor to HERBERT G. RUH, not individually, but as Trustee of the HERBERT G. RUH DECLARATION OF TRUST DATED August 2, 1994, as amended, and RUSSELL S. RUH, Successor to ALVENA H. RUH, not individually, but as Trustee of the ALVENA H. RUH DECLARATION OF TRUST DATED August 2, 1994, as amended, for property located on Lasher Road, Kaneville Township (Property Identification Numbers: 10-34-300-008 and 10-34-400-001) a...
