AUTHORIZING SIXTH (6TH) AMENDMENT TO THE AGREEMENT WITH THE KANE COUNTY AMERICAN RESCUE PLAN CONSULTANT AND CORRESPONDING USE OF ADDITIONAL STATE AND LOCAL FISCAL RECOVERY FUNDS

WHEREAS, per the clarification provided by the US Department of Treasury in Treasury's SLFRF FAQ 17.5, ARPA funds are allowed to be used after December 31, 2026 to pay for the Kane County ARPA Program administrative costs until the Program is closed; and
WHEREAS, the Kane County ARPA Program will be able to use ARPA funds to pay for Ernst & Young services beyond December 31, 2026; and
WHEREAS, it is necessary to amend the Ernst & Young LLP Statement of Work authorized in resolution 24-511 to increase the not to exceed amount in order for the Kane County ARPA Program to be able to continue to work closely with EY beyond December 31, 2026 for the purpose of conducting an internal review of every authorized and allocated amount of the Kane County SLFRF One Hundred Three Million, Four Hundred Thirteen Thousand, Forty-One Dollars ($103,413,041), closing of the ARPA Program and submitting the final report to the US Department of Treasury; and
WHEREAS, the Ernst & Young LLP Statement of Work is amended in the 6th Amendment as follows:
"... this Sixth Amendment is to add $150,000 to the Amended SOW not to exceed amount of $3,322,034 for a revised total not to exceed amount of $3,472,034 for services performed between November 9, 2021 and April 30, 2027. For the below amendments in this Sixth Amendment, the term "rate card" refers to the rate card in the Original SOW, dated November 11, 2021."
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board approves of the Sixth (6th) Amendment to Ernst & Young LLP Statement of Work, attached hereto, and authorizes the Kane County Board Chairman to execute this Sixth (6th) Amendment to Ernst & Young LLP Statement of Work, with the final form subject to the review and ad...
