APPROVING PRELIMINARY JUST COMPENSATION APPROPRIATION FOR THE ACQUISITION OF REAL PROPERTY FOR RANDALL ROAD AT HOPPS ROAD INTERSECTION AND CNRR GRADE SEPARATION IMPROVEMENT PROJECT, KANE COUNTY SECTION NO. 19-00511-00-CH, PARCEL NOS. 0001, 0002, 0002TE, 0003, 0003TE, 0006, 0006TE AND 0008

WHEREAS, the County of Kane (County) is authorized pursuant to the Illinois Compiled Statutes, 605 ILCS 5/5-801 (2020), to acquire real property for highway purposes by negotiated purchase; and
WHEREAS, the County has developed right-of-way plans for the Kane County Highway No. 34, (Randall Road) at Hopps Road intersection reconstruction and CNRR grade separation improvement in Elgin, Illinois, Kane County Sec. No.19-00511-00-CH, (hereinafter the "Project"); and
WHEREAS, the Project right-of-way plans require the acquisition of Project Parcel Nos. 0001, 0002, 0002TE, 0003, 0003TE, 0006, 0006TE and 0008; and
WHEREAS, the County has been authorized by the Illinois Legislature to use quick take authority to acquire these parcels consistent with Illinois Code of Civil Procedure, (See generally: 735 ILCS 30/1-1-1 et. seq., and in particular 735 ILCS 30/20-5-5 and 735 ILCS 30/25-5-5); and
WHEREAS, the County has engaged the services of an Illinois licensed appraiser and review appraiser and approved by the Illinois Department of Transportation for the purposes of providing a fair market value for each parcel the County needs to acquire to complete the Project; and
WHEREAS, the appraisals completed provide an estimated amount for each parcel's estimated preliminary just compensation determination as part of the quick take process consistent with any future eminent domain petitions filed to acquire any of the aforementioned parcels for the Project; and
WHEREAS, the estimated preliminary just compensation for Parcel No. 0001, 0002, 0002TE, 0003, 0003TE, 0006 , 0006TE and 0008, which are legal...
