APPROVING AN AMENDMENT TO A SETTLEMENT AGREEMENT WITH LIGHTHOUSE ACADEMY-HUNTLEY, LLC, REVISING THE IMPACT FEE PAYMENT SCHEDULE

WHEREAS, the County of Kane (“County”) and Lighthouse Academy-Huntley, LLC, (“Lighthouse”) entered into a settlement agreement regarding impact fees assessed for Lighthouse’s construction of a daycare facility in Huntley, Illinois; and
WHEREAS, the payment schedule agreed upon within the settlement agreement provides for monthly payments over a period of one (1) year; and
WHEREAS, Lighthouse has requested a revised payment schedule that will extend the period of time in which it can complete all payments contemplated within the original settlement agreement; and
WHEREAS, the Parties believe it to be in their best interest not to incur additional litigation expenses and time, and desire to amend the original settlement agreement by providing Lighthouse an additional six (6) months to pay the agreed upon impact fee assessment; and
WHEREAS, the County and Lighthouse propose to enter into an Amendment to the original settlement agreement, a copy of which is attached hereto as exhibit “A”, providing for an updated term and fee schedule as set forth therein.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the proposed amendment to the Settlement Agreement between the County and Lighthouse, revising the payment schedule as described therein is hereby approved, and the County Board Chair is authorized and directed to execute the amendment on behalf of the County of Kane.
BE IT FURTHER RESOLVED that all other terms and conditions of the Settlement Agreement shall remain in full force and effect.
