Approving Amendment to Chapter 16 of the Kane County Code (Planning and Development) Regarding Zoning Ordinance Fee Schedule

WHEREAS, Chapter 16 (Planning and Development), Article I (In General), Section 16-1 (Zoning Ordinance Fee Schedule) of the Kane County Code sets out the fees to be charged in connection with administering the County’s zoning ordinance; and
WHEREAS, Public Act 104-0458, effective June 1, 2026, amended section 5-12020 of the Counties Code (55 ILCS 5/5-12020), which governs a county’s authority to regulate commercial solar energy facilities; and
WHEREAS, Public Act 104-0458 also added a new section 5-12024 to the Counties Code (55 ILCS 5/5-12024), which governs a county’s authority to regulate energy storage systems; and
WHEREAS, the Kane County Development & Community Services Department has reviewed the fees set forth in Chapter 16 (Planning and Development), Article I (In General), Section 16-1 (Zoning Ordinance Fee Schedule) of the Kane County Code and recommends updates to that schedule, which are set forth in the attached Exhibit A, following the amendments made through Public Act 104-0458 to the Counties Code with respect to a county’s authority to regulate commercial solar energy facilities and energy storage systems.
NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that Chapter 16 (Planning and Development), Article I (In General), Section 16-1 (Zoning Ordinance Fee Schedule) of the Kane County Code is hereby amended as set forth in the attached Exhibit A.
