APPROVING AMENDMENT NO. 2 TO AN AGREEMENT WITH KIMLEY HORN AND ASSOCIATES, INC. OF WARRENVILLE, ILLINOIS FOR PLANK ROAD HSIP IMPROVEMENTS FROM ROMKE ROAD TO BRIER HILL ROAD, KANE COUNTY SECTION NO. 21-00540-00-SP

WHEREAS, pursuant to Resolution No. 22-28, the County of Kane approved a Phase I/II engineering services agreement (hereinafter the “Agreement”) with Kimley Horn and Associates, Inc. (“Consultant”) and appropriated Eight Hundred Seven Thousand Seven Hundred Twenty-Two Dollars ($807,722.00) (hereinafter the “appropriation”); and
WHEREAS, pursuant to Resolution No. 25-062, the County of Kane approved an amendment to the Agreement with Kimley Horn and Associates, Inc. (“Amendment #1”), which increased the original appropriation approved by the Board by an additional Twenty-Three Thousand One Hundred Fifty-Four Dollars ($23,154.00) from $807,722.00 to $830,876.00; and
WHEREAS, the terms of the Agreement and Amendment #1 between the County and Consultant are set to expire on January 12, 2027; and
WHEREAS, unobligated funds are still available under the original Agreement and Amendment #1 and Consultant is actively working towards completion of various tasks set forth within the scope of services included within the Agreement and Amendment #1; and
WHEREAS, it is in the County’s best interest to extend the expiration date of the Agreement between the parties from January 12, 2027, to January 12, 2030, to provide sufficient time to complete all of the approved tasks set forth within the Agreement and to expend the funds appropriated; and
WHEREAS, the County and Kimley Horn and Associates, Inc. wish to enter into Amendment #2 to the Agreement which provides for an extension of the expiration date of the original Agreement, a copy of which is attached hereto as exhibit “A”.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that this Amendment #2 to the Agreement with Kimley Horn and Associates, Inc. is hereby approved and that the Chairman...
