APPROVING ACCESSIBILITY EFFORTS RELATED TO THE COUNTY OF KANE WEBSITE AND AGENDAS FOR THE KANE COUNTY BOARD AND ITS COMMITTEES

WHEREAS, in April 2024, the United States Department of Justice ("DOJ") published a final rule to update its regulations for Title II of the Americans with Disabilities Act and address the accessibility of web content and mobile applications for individuals with disabilities; and

WHEREAS, pursuant to the DOJ regulations, the County of Kane must ensure that web content and mobile applications it provides or makes available comply with a specific technical standard (Web Content Accessibility Guidelines Version 2.1, Level AA compliance) by April 24, 2026; and

WHEREAS, the County of Kane currently posts agenda packets for the Kane County Board and its committees on its website, which include agendas, resolutions, ordinances, and supporting documentation, which may not always comply with the specific DOJ technical standards in the final rule; and

WHEREAS, the County of Kane is subject to the Open Meetings Act, which requires that an agenda for each regular meeting of a public body is be posted at least forty-eight (48) hours in advance of the holding of the meeting and also posted on the public body's website; and

WHEREAS, any agenda required under the Open Meetings Act shall set forth the general subject matter of any resolution or ordinance that will be the subject of final action at the meeting; and

WHEREAS, section 2-47(C) of the Kane County Code requires agendas to be sufficiently itemized to apprise members and the public of matters to be considered by the County Board; and

WHEREAS, the Kane County Board desires that, to maximize the availability of its agenda related content to all members of the public, the process for preparing agendas, resolutions, and ordinances for meetings of the Kane County Board and its committees shall account for c...
