Ordinance Approving Amendments to the General Use Ordinance Chapters 6 - Enforcement / Section 3 - Fines and Penalties

WHEREAS, it is reasonable, necessary, and desirable for the FOREST PRESERVE DISTRICT OF KANE COUNTY, a forest preserve district, organized and existing under the Illinois Downstate Forest Preserve District Act and related laws of the State of Illinois (hereinafter referred to as the "District") to establish a general use ordinance governing the use of the property of the District and to review and revise same from time-to-time; and
WHEREAS, subject to the provisions of 70 ILSC 805/7 et. seq., it is reasonable, necessary, and desirable for the District to provide rules and regulations in order to provide for the safe and peaceful use of the preserves of the District, for the education and recreation of the public; for the protection and preservation of the property, facilities, flora, and fauna of the District; and for the safety and general welfare of the public; and
WHEREAS, the District has the authority and the power to establish a general use ordinance and to revise and amend same from time-to-time; and
WHEREAS, the District has adopted a General Use Regulation Ordinance last amended on July 11, 2023 (also sometimes hereinafter referred to as the "General Use Ordinance"); and
WHEREAS, the District has the authority and power to enforce said General Use Ordinance and to establish fines and penalties for violations of that ordinance and methods of collection of same and update language to current regulations; and
WHEREAS, the Board of Commissioners of the District find it to be in the interest of the District and its residents to establish revisions to its General Use Ordinance as set forth herein.
