Resolution Approving an Intergovernmental Agreement Between the Forest Preserve District of Kane County and the City of Geneva

WHEREAS, Forest Preserve District Of Kane County, and the City of Geneva, Illinois desire to enter into an Intergovernmental Agreement for an engineering study to determine the feasibility of utilizing water from the City's waste water treatment facility for irrigation purposes at Settler's Hill Golf Course; and
WHEREAS, an intergovernmental agreement is appropriate and is authorized by Illinois compiled Statutes, Chapter 5, Section 220/1 et seq., and Article VII, Section 10 of the Constitution of the State of Illinois, 1970, authorize units of local government, including cities and forest preserve districts, to enter into agreements for cooperative use of land and property of each such district; and
WHEREAS, the DISTRICT has identified a need of the Settler's Hill Golf course for access to a permanent and reliable water source for irrigation purposes; and
WHEREAS, the CITY's Wastewater Treatment Facility is located within a half mile of the golf course and may have the ability to supply re-use water for irrigation purposes; and
WHEREAS, the CITY is currently under contract with the engineering firm CDM Smith for improvements to its existing wastewater treatment facility; and
WHEREAS, the District and City have determined that an engineering study utilizing the City's existing contract with CDM Smith Engineering is the appropriate next step in determining the feasibility of reuse water for irrigation at Settler's Hill Golf Course, including the study of available pipelines and /or routes between the Wastewater Treatment Facility and Settler's Hill Golf Course; and
WHEREAS, the District shall contribute $54,800.00 to the City of Geneva for the engineering study to be performed by CDM Smith Engineering. Additionally, a contingency...
