WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that "units of local government and school districts may contract or otherwise associate among themselves . . . [and] with individuals, associations, and corporations in any manner not prohibited by law or by ordinance"; and

WHEREAS, Kane County, in order to promote the public's safety and welfare, wishes to assist its law enforcement agencies in accessing mental health resources, including counselors or therapists; and

WHEREAS, the Kane County Board has the authority to "impose additional duties, powers and functions upon county officers" (55 ILCS 5/5-1087); and

WHEREAS, the Kane County State's Attorney desires to provide mental health resources to its employees (see 55 ILCS 5/3-9006); and

WHEREAS, the Kane County Board recognizes that the Kane County State's Attorney, as the elected official responsible for the operations of her office, is the county officer best situated to determine if and when it is appropriate to enter into agreements related to sharing the services of a wellness program coordinator; and

WHEREAS, pursuant to Resolution 25-55, the Kane County Board previously authorized the Kane County Sheriff's Office and the Kane County State's Attorney's Office to enter into an Intergovernmental Agreement with the County of Kendall for Sharing the Services of a Wellness Program Coordinator; and

WHEREAS, the Kane County Sheriff's Office no longer wishes to be a party of the Intergovernmental Agreement, which has been updated and adjusted accordingly; and
