ESTABLISHING THE COLLECTION AND DISTRIBUTION OF CERTAIN COURT FINES, FEES, AND ASSESSMENTS, AND REPEALING AND REPLACING RESOLUTION 20-82

WHEREAS, the Illinois Criminal and Traffic Assessment Act, 705 ILCS 135/1, et seq.; Clerks of Courts Act, 705 ILCS 105/27.1, et seq.; and the Illinois Counties Code, 55 ILCS 5/1, et seq.; authorize the collection the amounts of certain fines, fees, and assessments collected by the Clerk of the Circuit Court, where established by resolution or ordinance of the County Board; and
WHEREAS, on March 10, 2020, the Kane County Board passed Resolution 20-82 to establish the current schedule of fines, fees, and assessments collected by the Clerk of the Circuit Court; and
WHEREAS, effective July 1, 2026, the Illinois General Assembly has enacted Public Act 104-0468, which amends the Clerks of Courts Act and increases certain civil filing and appearance fees by Five Dollars ($5.00) to be distributed to the State of Illinois for purposes of establishing a Guardianship and Advocacy Fund; and
WHEREAS, in order to reflect the amendments to the Clerks of Courts Act pursuant to Public Act 104-0468, the County Board desires to update the schedule of fines, fees and assessments collected by the Clerk of the Circuit Court.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Clerk of the Circuit Court of the Sixteenth Judicial Circuit, Illinois, is hereby authorized to collect and distribute fees, fines, and assessments as set forth on Exhibit 1 attached hereto and incorporated by reference, and as authorized by law, shall remit said fees to the Kane County Treasurer for deposit as specified therein.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Kane County Board that Resolution 20-82 is repealed and replaced in its entirety by this Resolution.
