WHEREAS, under Section 501(a) of Division N of the Consolidated Appropriations Act, 2021, Pub. L. No. 116-260 (the Act), Kane County was eligible to apply for and receive federal funding to be used to provide emergency rental assistance to eligible households that are unable to pay housing costs due to the COVID-19 pandemic; and

WHEREAS, the County of Kane, through its former Office of Community Reinvestment, has received $15,533,153.00 from the U.S. Department of Treasury through the Emergency Rental Assistance Program 2 (ERAP2); and

WHEREAS, ERAP2 funds must be spent by September 30, 2025; and

WHEREAS, it is desirable to collaborate with other government agencies, such as the Illinois Housing Development Authority ("IHDA"), to implement the program and to allocate the available funding; and

WHEREAS, County staff have participated in discussions with IHDA regarding the feasibility and efficiency of that agency administering some of the County's emergency rental assistance award, in a manner that is consistent with Federal rules and regulations under the Emergency Rental Assistance Program 2; and

WHEREAS, the Intergovernmental Cooperation Act (5 ILCS 22/1 et seq.), enacted by the State of Illinois permits the establishment of intergovernmental agreements between public agencies to perform governmental services, activities and undertakings; and

WHEREAS, such an intergovernmental agreement has been developed that outlines the terms and conditions associated with the County making available up to but not to exceed $_______________________ to IHDA to provide direct assistance to eligible households and/or use funds for eligible affordable rental housing projects and other eligible activities, and to cover eligible...
