Approval of Final Consent Order 2019-CH-789

WHEREAS, the County of Kane is a party to pending litigation styled People of the State of Illinois ex rel. Kwame Raoul v. Waste Management of Illinois, Inc. 2019-CH-789 which alleges a discharge of 1,4-dioxane from Midway and Settler’s Hill landfills had an impact on certain private water wells as to which the County has an interest; and
WHEREAS, the parties entered into an Agreed Preliminary Injunction Order on March 2, 2020, which was modified on August 8, 2023, by agreement of the parties; and
WHEREAS, the Final Consent Order requires a signature by an authorized representative of Kane County.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Final Consent Order if approved and the Chairperson of the Kane County Board is authorized to execute documents associated therewith.
