Amending Chapter 15 (Nuisances and Property Maintenance) of the Kane County Code to Declare Trespassing a Public Nuisance

WHEREAS, the County of Kane, a body politic and corporate of the State of Illinois, is a non-home rule unit of local government pursuant to Article VII, Section 7, of the Illinois Constitution of 1970; and
WHEREAS, pursuant to section 55 ILCS 5/5-1004 of the Counties Code (55 ILCS 5/5-1004), the powers of the County of Kane as a body corporate or politic shall be exercised by the Kane County Board; and
WHEREAS, pursuant to section 47-5 of the Criminal Code of 2012 (720 ILCS 5/47-5), counties have the authority to declare what shall be public nuisances and abate them the same with respect to the territory within the county but outside the corporate limits of any city, village, or incorporated town; and
WHEREAS, there have been complaints in Kane County regarding individuals entering onto privately owned land in unincorporated areas of Kane County without authority for purposes that include, but are not limited to, fishing and loitering; and
WHEREAS, the Kane County Board has determined that it is in the best interest of the County of Kane to declare that trespassing on privately owned land is a public nuisance in areas outside the corporate limits of cities, villages, and incorporated towns in Kane County.
NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that Chapter 15 (Nuisances and Property Maintenance) is hereby amended as reflected in Exhibit A.
