AUTHORIZING INTERGOVERNMENTAL EQUIPMENT SHARING AGREEMENTS FOR EMERGENCY MANAGEMENT UNMANNED EQUIPMENT

WHEREAS, the Kane County Office of Emergency Management ("OEM") maintains and operates various emergency management equipment, including but not limited to light towers, generators, and other unmanned support assets used in support of emergency preparedness, response, and planned public safety operations; and

WHEREAS, public safety agencies within Kane County and surrounding jurisdictions periodically request the temporary use of such equipment for planned events, emergency preparedness activities, and operational support; and

WHEREAS, the County and its local governments are authorized under Article VII, Section 10 of the Illinois Constitution and the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) to enter into intergovernmental agreements to jointly exercise powers and share services and resources in a manner not prohibited by law; and

WHEREAS, the OEM has historically permitted the sharing of such equipment to support regional public safety operations, and now desires to formalize those practices through written intergovernmental agreements to ensure consistency, accountability, and protection of public assets; and

WHEREAS, formalizing equipment-sharing agreements will promote operational efficiency, strengthen interagency cooperation, and ensure that County-owned equipment is properly safeguarded, maintained, and accounted for during periods of temporary use; and

WHEREAS, , the County Board further finds it in the best interests of the County to establish clear responsibility for equipment condition, including fuel replacement and liability for loss or damage, consistent with the Intergovernmental Services Agreement template.
