Approving Text Amendments to Kane County Zoning Ordinance, Chapter 25 of the Kane County Code (Zoning), Regarding Commercial Solar Energy Facilities and Energy Storage Systems in the Unincorporated Areas of Kane County (Zoning Petition No. 5008)

WHEREAS, the Kane County Board has adopted a Zoning Ordinance, Chapter 25 of the Kane County Code, dividing the unincorporated areas of the County into zoning districts for the purpose of regulating land use; and
WHEREAS, the Kane County Zoning Ordinance is adopted for the purpose of promoting the public health, safety, morals, comfort, and general welfare; conserving the values of property throughout the County; and reducing or avoiding congestion in the public streets and highways; and
WHEREAS, it is necessary from time to time to amend the Kane County Zoning Ordinance to continue to provide effective enforcement; and
WHEREAS, Public Act 104-0458, effective June 1, 2026, amended section 5-12020 of the Counties Code (55 ILCS 5/5-12020), which governs a county’s authority to regulate commercial solar energy facilities; and
WHEREAS, Public Act 104-0458 also added a new section 5-12024 to the Counties Code (55 ILCS 5/5-12024), which governs a county’s authority to regulate energy storage systems and requires a zoning ordinance in compliance with section 5-12024 by September 29, 2026; and
WHEREAS, for compliance with Public Act 104-0458 and the Counties Code, it is necessary for the County to approve text amendments to the Kane County Zoning Ordinance, codified at Chapter 25 of the Kane County Code (Zoning), as set forth in the attached Exhibit A, which includes revisions to section 25-5-4-9 of the Kane County Code (Commercial Solar Energy Facilities) and also the addition of a new section 25-5-4-10 of the Kane County Code (Energy Storage Systems); and
