Resolution Authorizing a Third Amendment with the Fox Valley Park District for the Use of Oakhurst Forest Preserve for a Community Garden

WHEREAS, it is deemed necessary and desirable to make a third amendment to the license Agreement between the Forest Preserve District of Kane County and the Fox Valley Park District, for the use of approximately five (5) acres of open space at Oakhurst Forest Preserve; and
WHEREAS, the Fox Valley Park District has established 250’x20’x30’ garden plots for residents of the area and have expressed the desire to amend the license agreement with the District for the use of five (5) acres at Oakhurst Forest Preserve for an additional five (5) years, terminating November 30, 2035; and
WHEREAS, the Fox Valley Park District has requested to install a semi-permanent water service to the garden site; and
WHEREAS, the attached agreement sets forth the respective responsibilities and rights of each of the parties to said agreement; and
WHEREAS, the parties have agreed that for and in consideration of the performance of certain conditions set forth in the original License Agreement, as extended in the first and second amendment, and in consideration of the undertakings herein set forth in the third amendment.
NOW, THEREFORE, BE IT RESOLVED, by the Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois, that the agreement attached hereto and made part hereof is hereby approved and that the President and Secretary of the District, be, and hereby are authorized to execute on behalf of the District.
