Approving an Amendment to an Intergovernmental Agreement Between the County of Kane and Village of Carpentersville for Access to Randall Road from Huntley Road to Binnie Road

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Intergovernmental Cooperation Act of the Illinois Compiled Statutes, 5 ILCS 220/1, et seq. authorizes the County of Kane (County) and the Village of Carpentersville (Carpentersville) to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and
WHEREAS, pursuant to Kane County Resolution No. 98-204, the County and Carpentersville entered into an intergovernmental agreement to allow access and improvements to Randall Road from Huntley Road to Binnie Road (hereinafter the “Agreement”); and
WHEREAS, the County and Carpentersville desire to amend the Agreement (hereinafter “Amendment No. 1” (a copy of which is on file with the County Clerk’s Office) to modify the existing Right-In-Only access to the west side of Randall Road to be a Right-In/Right-Out access; and
WHEREAS, the County finds the proposed Amendment No. 1 of the Agreement to be a benefit for the citizens of Carpentersville and the County of Kane and will provide for the safety of the motoring public and enhance the efficient movement of traffic.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Amendment No. 1 to the Agreement for Access Improvements to Randall Road from Huntley Road to Binnie Road is hereby approved and that the County Board Chairman is hereby authorized to execute an Amendment No. 1 to the Agreement with the Village of Carpentersville.
