Approving an Amendment No. 3 to the Phase II Engineering Services Agreement with BLA, Inc. of Itasca, Illinois for Kirk Road over Union Pacific Railroad, Kane County Section No. 12-00192-04-BR

WHEREAS, pursuant to Resolution No. 21-268, the County of Kane approved a Phase II Engineering Services Agreement (hereinafter the “Agreement”) with BLA, Inc. and appropriated One Million Five Hundred Thirty-One Thousand Two Hundred Fifty-Two Dollars ($1,531,252.00), (hereinafter the “appropriation”) for the improvement of Kirk Road over Union Pacific Railroad (hereinafter the “Improvement”); and
WHEREAS, pursuant to Resolution No. 22-343, the County approved an additional appropriation in the amount of Two Hundred Twenty-Four Thousand Two Hundred Fifty-Four Dollars ($224,254.00) and entered into Amendment No. 1 to the Agreement with BLA, Inc. (hereinafter referred to as Amendment No. 1); and
WHEREAS, pursuant to Resolution No. 25-096, the County approved to extend the date of the Agreement by three (3) years from the date of expiration from Kane County Resolution No. 21-268 (or December 31, 2027) and entered into Amendment No. 2 to the Agreement with BLA, Inc., (hereinafter referred to as Amendment No. 2); and
WHEREAS, the term of the Agreement was for three and a half years and shall expire before completion of the previously approved Improvement; and
WHEREAS, in order to address the need for the additional engineering services, the County desires to amend the Agreement (hereinafter Amendment No. 3), by and extending the expiration date of the Agreement to December 31, 2029 and increasing the cost of engineering services and additional One Hundred Forty-Six Thousand Two Hundred Ninety-Six Dollars ($146,296.00); and
WHERAS, it is in the County’s best interest to extend the upper limit of the appropriation as set forth in the Agreement and the Amendments by and additional One Hundred Forty-Six Thousand Two Hundred Ninety-Six Dollars ($146,296.00) from One Million Seven Hundred Fifty-Five Thousand Five Hundred and Six Dollars ($1,755,506.00) to One Million Nine Hundred One Thousand Eight Hundred Two Dollars ($1,901,802.00).
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Amendment No. 3 to the Agreement with BLA, Inc. is hereby approved and that the Kane County Chairman is hereby authorized and directed to execute the Amendment No. 3.
BE IT FURTHER RESOLVED by the Kane County Board that there is hereby appropriated the sum of One Hundred Forty-Six Thousand Two Hundred Ninety-Six Dollars ($146,296.00) from Motor Fuel Tax Fund #302, Line Item #50140 (Engineering) for a total appropriation for the Agreement and Amendments not to exceed One Million Nine Hundred One Thousand Eight Hundred Two Dollars ($1,901,802.00).
