Authorizing FY24 Public Defender’s Office Budget Adjustment

WHEREAS, the Kane County Public Defender’s Office is charged with the statutory duty to defend the rights of indigent people in Kane County in criminal and juvenile delinquency and abuse and neglect matters; and
WHEREAS, Assistant Public Defenders have completed the same amount of schooling and have passed the same Bar Examination as Assistant State’s Attorneys; and
WHEREAS, Assistant Public Defenders perform similar legal duties as Assistant State’s Attorneys; and
WHEREAS, the State’s Attorney has requested $1,544,070 in merit increases for Fiscal Year 2024; and
WHEREAS, the Public Defender is to receive $156,712 in salaries and wages as part of the Equity Adjustments; and
WHEREAS, the salaries of Assistant Public Defenders and Assistant State’s Attorneys with the same number of years as licensed attorneys and similarly situated responsibilities will not be equal with Assistant Public Defender making far less than their counterparts in the State’s Attorney’s Office; and
WHEREAS, in an effort to retain experienced attorneys and maintain adequate staffing levels, the salaries and wages for Assistant Public Defenders must be increased as a matter of equity to reflect the comparable positions and salaries of Assistant State’s Attorneys in Fiscal Year 2024; and
WHEREAS, a Fiscal Year 2024 budget amendment is necessary to fund equitable salary increases.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board that the following amendment be made to the Fiscal Year 2024 Budget:
