Amending County Code Section 2-212 Purchases Below the Simplified Acquisition Threshold

WHEREAS, the Kane County Code Ch. 2, Art. VI. § 2-217 authorizes emergency purchases exceeding the simplified acquisition threshold of thirty thousand dollars ($30,000.00) with approval of the County Board Chair; and
WHEREAS, the Kane County Code Ch. 2, Art. 2., § 2-212 further authorizes micro purchases of less than ten thousand dollars ($10,000.00) with approval of a Department Head; and
WHEREAS, the Kane County Code Ch. 2, Art. 2., § 2-212 currently requires a competitive price quotation process for small purchases greater than ten thousand dollars ($10,000.00) and less than the simplified acquisition threshold of thirty thousand dollars ($30,000.00), without providing an exception for small purchases under emergency circumstances; and
WHEREAS, disasters and emergencies may occur at any time, including outside normal business hours, and may require immediate purchases or expenditures to protect life, preserve property, and stabilize emergency conditions; and
WHEREAS, the Office of Emergency Management may be called upon to provide immediate services during disaster and emergency conditions; and
WHEREAS, obtaining competitive price quotations during nights, weekends, or holidays may not be feasible and may delay critical response actions, thereby increasing risk to life and property.
NOW, THEREFORE, BE IT ORDAINED that the Kane County Board amends and restates Kane County Code Section Ch. 2, Art. 2., § 2-212 subsection A, paragraph 2 as follows:
“Small Purchases: Procurement of materials, services, supplies, equipment, construction or construction related services that are at least ten thousand dollars ($10,000.00) ($2,000.00 for those construction projects subject to the Davis-Bacon act) and less than the simplified acquisition threshold of thirty thousand dollars ($30,000.00) may be awarded by department heads and/or the director of purchasing where there has been a competitive price quotation process and at least three (3) quotations have been obtained prior to selection. In the event of a bona fide emergency, with the approval of the Director of Purchasing, the Director of the Office of Emergency Management may forgo the competitive price quotation process for purchases that are greater than ten thousand dollars ($10,000.00) and less than the simplified acquisition threshold of thirty thousand dollars ($30,000.00).”
BE IT FURTHER ORDAINED, that this amendment shall be effective upon adoption.
