Authorizing an Intergovernmental Agreement for a Drone as First Responder Program Between the County of Kane, the Kane County Sheriff’s Office, and the City of Aurora Through the Aurora Police Department

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power of function in any manner not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay cost related to intergovernmental activities; and

 

WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service, provided that the unit of government contracting with the county has authority to perform the service; and

 

WHEREAS, the Parties are authorized to contract among themselves to obtain or share services, or exercise, combine, or transfer any power or function in any manner not prohibited by law (5 ILCS 220/3); and

 

WHEREAS, the Kane County Sheriff’s Office (KCSO) and the Aurora (IL) Police Department (APD) intend to cooperate in planning, deployment, and operation of a drone as a First Responder program (“DFR Program”) to enhance public safety and support law enforcement operations within their respective jurisdictions; and

 

WHEREAS, KCSO has leased a drone platform and associated software on a trial basis from Flock Group Inc., and APD will provide pilots and operational support for monitored calls for service to enable timely drone deployment; and

 

WHEREAS, the IGA is effective on the date of the last signature and may be terminated upon 30 days' written notice by either party.

 

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane and the Kane County Sheriff are authorized to enter an intergovernmental agreement with the City of Aurora and its police department for a Drone as First Responder program and that the Kane County Board Chairman is hereby authorized to execute the agreement.
