Resolution Approving an Intergovernmental Agreement Between the Village of Campton Hills and the Forest Preserve District of Kane County Concerning Annexation and Regulatory Development of Certain Property

WHEREAS, the Forest Preserve District of Kane County (District) and the Village of Campton Hills (Village) desire to enter into an intergovernmental agreement concerning the annexation and regulatory development of parcels to be acquired by the District within the Village of Campton Hills; and
WHEREAS, Section 10 of Article 7 of the Illinois Constitution of 1970 authorizes units of local government to contract or otherwise associate among and between themselves in any manner not otherwise prohibited by law or ordinance; and
WHEREAS, Section 3 of the intergovernmental Cooperation Act, 5 ILCS 22011 el seq. permits any powers, privileges or authority exercised or which may be exercised by a unit of local government to be exercised jointly with any other unit of local government; and
WHEREAS, the District has agreed to purchase approximately 323 acres of property from Shodeen Construction Company, LLC, as part of a proposed planned unit development to be constructed in the Village, and the District will be simultaneously receiving the donation of an additional 77+/- acres of property from Shodeen; and
WHEREAS, the District is taking ownership of these parcels for its own purposes and as part of a cooperative agreement among other entities whose mission is conservation of open space; and
WHEREAS, the Village and District desire to memorialize their agreement concerning the
jurisdiction of the Village over the land uses and improvements on the property to be acquired by or donated to the District.
NOW, THEREFORE, BE IT RESOLVED, by the Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois that the agreement attached hereto and made part hereof is hereby approved by the President and Secretary of the District, be and hereby are authorized to execute on behalf of the District.
